Terms of service

These terms cover your use of Comulu. They are written to be readable; where a clause matters commercially, it says what it means in plain language.

  1. 1.The service

    Comulu is a hosted commerce platform. It lets you generate, edit, publish and operate online stores, including the storefront, catalogue, orders, customers and the tools around them.

    We may change, add or remove features. When a change materially reduces what a paid plan includes, we will tell you before it takes effect.

  2. 2.Your account

    You need an account to create a store, and you are responsible for what happens under it. Keep your credentials safe and tell us promptly if you believe someone else has access.

    You must be legally able to enter into a contract, and you may not use Comulu if we have previously suspended your account.

  3. 3.Your content and your store

    Everything you upload or create — product data, copy, images, customer records, orders — remains yours. You grant us the licence we need to host, process and display it in order to run the service on your behalf.

    You are responsible for the legality of what you sell and publish, for the accuracy of your product information, and for the terms you offer your own customers.

  4. 4.AI-generated output

    Generated stores, pages, product copy and app drafts are suggestions. Review them before publishing. We do not warrant that generated output is accurate, original, or suitable for a particular market, and you remain responsible for anything you publish.

    Do not use the service to generate content that is unlawful, deceptive, infringing, or that misrepresents products, health effects, certifications or origin.

  5. 5.Acceptable use

    You may not use Comulu to:

    • sell goods or services that are illegal where you operate, or that a payment provider prohibits;
    • infringe intellectual property, impersonate a brand, or misuse someone else’s data;
    • probe, overload or disrupt the platform, or attempt to bypass tenancy or access controls;
    • resell the platform as your own without a written agreement.
  6. 6.Plans, billing and cancellation

    Paid plans are billed monthly in advance at the prices published on the pricing page. Taxes are added where applicable.

    When you move to a higher plan yourself, the difference for the rest of the current period is charged straight away; a move to a lower plan is credited against your next invoice.

    You can cancel at any time and keep access until the end of the paid period. We do not pro-rate the period you cancel in. If we increase prices, we will give you at least 30 days notice before your next renewal.

  7. 7.Monthly sales limits (GMV)

    Each plan covers a monthly gross merchandise value (GMV): Starter up to $50,000, Scale up to $100,000, Pro up to $500,000. Enterprise is agreed individually, from $500,000 a month. The Free plan covers up to $50,000. Pro (legacy) and Business plans have no GMV limit.

    GMV is the total of the paid and partially refunded orders placed in a calendar month (UTC) on the stores you created, including tax and shipping. Cancelled, fully refunded, pending, demo and test orders are excluded. Orders in other currencies are converted to US dollars at rates we fix for each month from the National Bank of Poland’s reference rates; an order in a currency without a rate is not counted.

    A month closes three days after it ends, and its GMV is then final. Measurement starts with November 2026.

    If a closed month is above your current plan’s limit, on the 8th day of the following month we move your subscription to the smallest plan whose limit covers that month. Its limits apply straight away; its price applies from your next billing date. Nothing is charged or pro-rated before then, and nothing on your store is paused or blocked. Your dashboard shows the change and its date before it takes effect.

    Above $500,000 a month there is no automatic change; we will contact you to agree an Enterprise plan. Without a paid subscription, we ask you in the dashboard to choose a plan that covers your sales and charge nothing automatically. Plans never move down automatically. You can move to a lower plan yourself while neither the current month nor the last closed month is above its limit.

  8. 8.Build offer

    New accounts that choose Starter get the Build offer: 50% off, so Starter costs $99.50 instead of $199 a month, for up to 3 months. The 3 months run from the day your subscription starts, including any free trial.

    The offer ends early, without a refund for the current period, as soon as a custom domain goes live on any store you created, or when you move to another plan. Your next invoice is then at the full Starter price. The offer applies once per account and only to Starter, and is not available to an account that already has a live custom domain.

  9. 9.Suspension and termination

    We may suspend a store that breaches these terms, puts the platform at risk, or is the subject of a valid legal complaint. Where the situation allows, we will contact you first and give you a chance to fix it.

    You can delete your store at any time. After deletion we remove your data on the schedule described in the privacy policy.

  10. 10.Warranties and liability

    The service is provided as-is. We work hard on availability and durability, but we do not promise the service will be uninterrupted or error-free.

    To the extent the law allows, our aggregate liability is limited to the fees you paid us in the twelve months before the event giving rise to the claim, and we are not liable for lost profits or indirect damages.

  11. 11.Changes to these terms

    We may update these terms. If a change is material, we will notify you by email or in the dashboard before it applies. Continuing to use the service after that date means you accept the updated terms.
